Terms and Conditions

1. Definitions and scope

“PropertiLo”, “we”, “us” and “our” mean the operator of the PropertiLo platform. “User” and “you” include visitors, members, owners, agents, builders, advertisers and anyone using the platform. “Listing” means property information, photographs, advertisements and related content made available through PropertiLo.

These Terms apply to all current and future PropertiLo services unless a service displays additional terms. The Privacy Policy and Listing Disclaimer form part of these Terms.

2. Eligibility and acceptance

• You must be at least 18 years old and legally competent to enter into a binding contract under Indian law to create an account or submit content.
• If you use PropertiLo for a business, agency, developer or other organisation, you confirm that you have authority to bind that organisation.
• You accept these Terms when you access the platform, create an account, submit a listing, send an enquiry, make a claim or otherwise use a service that refers to them.

3. Accounts and security

• Provide complete, current and accurate account information and keep it updated.
• Keep your password and verification codes confidential. You are responsible for activity performed through your account unless you promptly report unauthorised access.
• Do not create misleading identities, impersonate another person, transfer an account without permission or use another user’s account.
• We may require phone, email, identity, authority or property-related verification where reasonably necessary for safety, claims, moderation or legal compliance.

4. Listings and advertiser responsibilities

A user who publishes or manages a Listing is responsible for its accuracy, legality and continued availability. PropertiLo may assist with formatting, categorisation, translation or presentation without assuming responsibility for the underlying information.

• You must own the property or have valid authority from the owner, developer or authorised representative to advertise it.
• Listing descriptions, price, location, area, amenities, availability, ownership status, approvals, possession status and contact information must be truthful and not materially misleading.
• You must comply with applicable real-estate, advertising, consumer, tax and RERA requirements, including displaying registration details where legally required.
• Do not publish duplicate, fake, bait, unavailable, unlawfully discriminatory, prohibited or unauthorised Listings.
• Remove or update a Listing promptly when it is sold, rented, withdrawn or materially changed.

5. Listings created from public advertisements

PropertiLo may create discovery Listings from newspaper advertisements or other lawfully available public advertising material. These Listings may be translated, structured or summarised and should be treated as unverified until claimed or independently confirmed.

A rightful owner or authorised representative may use the claim process to request control or correction. Any person may report inaccurate, expired, duplicate, infringing or unauthorised content. We may request evidence before acting and may approve, reject or investigate a request based on the information available.

6. User content and licence

You retain ownership of content you submit. You grant PropertiLo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, translate, resize, display, distribute and use that content to operate, secure, moderate and promote the platform and the relevant Listing. This licence ends when the content is removed, except for backups, legal records and material already shared as part of the service.

You confirm that you have all rights and permissions needed for submitted text, photographs, logos, floor plans, documents and contact details, and that the content does not violate privacy, confidentiality, intellectual-property or other rights.

7. Enquiries, claims and contact sharing

When you send an enquiry, claim or report, you authorise PropertiLo to process it and to share the information reasonably needed with platform administrators and, where appropriate, the relevant advertiser, owner or approved claimant. An enquiry is not an offer, booking or guarantee of a response.

Users receiving contact details or enquiries may use them only for the relevant property request. They must not sell the information, add the person to unrelated marketing lists, harass them or use it for an unlawful purpose.

8. Independent verification and property transactions

PropertiLo does not guarantee a Listing’s identity, ownership, title, encumbrances, approvals, RERA status, measurements, condition, availability, price, expected return or suitability. Badges, moderation, claims and verification steps reduce risk but do not replace due diligence.

Before paying, signing or sharing sensitive documents, independently inspect the property and verify the advertiser, title, approvals, taxes, encumbrances, measurements, agreement terms and payment instructions. Obtain advice from qualified legal, technical and financial professionals. Transactions and disputes remain between the users involved.

9. Prohibited use

• Do not commit fraud, misrepresentation, harassment, discrimination, infringement, money laundering or any unlawful act through PropertiLo.
• Do not upload malware, attempt unauthorised access, bypass security or rate limits, probe vulnerabilities, disrupt services or interfere with another user’s account.
• Do not scrape, harvest, copy or systematically extract Listings, contact details or platform data without written permission.
• Do not send spam, unsolicited bulk messages or use enquiries for unrelated solicitation.
• Do not manipulate rankings, reviews, claims, reports, traffic or engagement, or submit false evidence to obtain control of a Listing.

10. Moderation and enforcement

We may review, edit for presentation, request evidence for, restrict, reject, deactivate or remove content that appears inaccurate, expired, duplicate, disputed, unlawful, unsafe or inconsistent with these Terms. We may warn, restrict, suspend or terminate accounts and preserve relevant records where reasonably necessary.

Moderation is performed on a reasonable-efforts basis and does not mean that we endorse or guarantee content. We are not obliged to pre-screen every Listing or communication.

11. Platform communications

We may send account, security, enquiry, claim, Listing, support and other service-related communications by email, SMS, WhatsApp, phone or in-platform notification where necessary to provide a requested service or as otherwise permitted by law.

Promotional communications will be sent only where we have the consent or other lawful permission required for that channel and will respect applicable preferences and opt-out requests. Acceptance of these Terms by itself is not consent to unrelated promotional messages.

12. Privacy

Our Privacy Policy explains what personal data we collect, why we use it, when it may be shared, how long it may be retained and the choices available to you. Do not upload unnecessary identity documents or sensitive personal information in a public Listing.

13. Fees and paid services

Some services may be free and others may become paid. Before a paid service is purchased, we will display the applicable price, taxes, duration and material conditions. Any service-specific cancellation or refund terms shown at purchase will also apply. We will not charge merely because these Terms mention possible paid services.

14. Intellectual property

PropertiLo’s name, logo, software, interface, design, databases and platform-created content are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the platform for lawful personal or business property-discovery purposes. No ownership right is transferred to you.

15. Third-party services

The platform may contain maps, messaging tools, payment links, advertisements or links operated by third parties. Their own terms and privacy practices apply. PropertiLo is not responsible for a third party’s content, availability, security or performance merely because it is linked or integrated.

16. Availability and disclaimers

The platform is provided on an “as available” basis. To the extent permitted by law, we do not promise uninterrupted operation, error-free content, a particular number or quality of responses, successful sale or rental, or continued availability of any feature. We may maintain, modify, suspend or discontinue features while taking reasonable steps to avoid unnecessary disruption.

Nothing on PropertiLo is legal, financial, investment, tax, architectural or technical advice. Statutory rights that cannot lawfully be excluded remain unaffected.

17. Limitation of liability

To the maximum extent permitted by applicable law, PropertiLo will not be liable for indirect, incidental, special, punitive or consequential loss, loss of profit or opportunity, user conduct, inaccurate Listings, failed negotiations, property defects, title disputes, third-party services or unauthorised payments. Nothing in these Terms excludes liability that cannot be excluded under law.

18. Indemnity

To the extent permitted by law, you agree to indemnify PropertiLo and its personnel against third-party claims, losses and reasonable costs arising from your unlawful use of the platform, your content, your property transaction, your infringement of another person’s rights or your material breach of these Terms. This does not apply to the extent a claim results from PropertiLo’s own unlawful conduct.

19. Suspension and termination

You may stop using the platform at any time and may request account assistance through Contact Us. We may suspend or terminate access for material or repeated breach, fraud, security risk, legal requirement or conduct that may harm users or the platform. Provisions that by their nature should survive termination—including ownership, licences already exercised, disclaimers, liability, indemnity and dispute provisions—will survive.

20. Changes to these Terms

We may update these Terms to reflect service, legal or security changes. The revised version will show a new update date. Where a change materially affects registered users, we will take reasonable steps to provide notice. Continued use after the effective date means acceptance of the revised Terms; if you do not agree, stop using the affected services.

21. Governing law and disputes

These Terms are governed by the laws of India. Before starting formal proceedings, you and PropertiLo should attempt in good faith to resolve the issue through the Contact Us channel. Subject to applicable law and any jurisdiction that cannot lawfully be excluded, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the use of PropertiLo. Mandatory consumer rights and statutory remedies remain available.

22. General provisions

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent; we may assign these Terms as part of a lawful reorganisation or transfer of the platform. These Terms, the Privacy Policy, the Listing Disclaimer and applicable service-specific terms form the agreement concerning your use of PropertiLo.

23. Contact and grievances

For questions, listing disputes, claims, reports, privacy requests or grievances, use the Contact Us page or the relevant claim/report option on a property page. Include the account email, property link and a clear description, but do not send passwords, OTPs or unnecessary identity documents.
